Re: Your letter ENG/L/112, extension of time for Milestone M-14

We respond to each point in your letter of 28 March 2025.

1. Notice was given in time. The Site Access Instruction was issued on 14 March 2025 and our Delay Notice DN/M14/014 followed on 19 March 2025, five days later and well within the 28 days allowed by Sub-Clause 20.1.

2. The restriction sits on the critical path. Baseline_Rev_3 shows activities A1020, A1180 and A1410 with zero float, and the updated programme shows a 14-day slip to Milestone M-14.

3. The 42-day period for fully detailed particulars under Sub-Clause 20.1 does not expire until 25 April 2025. We will submit them within that period.

We therefore ask the Engineer to withdraw the rejection and proceed to a determination under Sub-Clause 3.5.

How it works

From the Engineer · ENG/MER/0217

Re: Extension of time claim, Milestone M-14

…notice was not given within 28 days. The claim is time-barred.
…did not affect the critical path.
…no detailed particulars have been submitted.
