Across the Particular Conditions and the Section A1 correspondence: when was full land handover due and when did it happen? Was VCON’s notice inside the Sub-Clause 20.1 window, and what are we claiming? Can the Employer levy delay damages yet, and what does the Engineer’s slow-progress notice require from us?
ReadParticular ConditionsEOT noticeEOT claimEngineer’s notice

Short answer: the land notice was valid and delay damages are blocked for now, but the Engineer’s recovery demand needs a reply within 14 days.

1.

Handover. Full encumbrance-free possession of Section A1 was due on 05-Dec-2016and was only confirmed on 18-Feb-2017, 75 days late. Partial access before then does not count: fragmented access that does not enable the planned operation is not full handover.

2.

Notice. VCON’s notice LAND-001 is dated 02-Jan-2017, within 28 days of the missed milestone. That is enough under Sub-Clause 20.1, which only needs the event, the clause basis and the likely effect.

3.

The claim. A 75-day extension of time and INR 22.00 Crore in prolongation cost, supported by a time-impact analysis at the 05-Dec-2016 status point.

4.

Delay damages. The rate is INR 2.5 Crore a day, capped at INR 500 Crore, but none can be levied until the pending EOT claim is determined.

5.

Slow progress. The Engineer records 32% actual progress against 45% plannedand argues the slippage started before the land milestone. Expect that point to be used against concurrency, so it needs an answer.

Recommended next stepSubmit the recovery programme within 14 days with a 31-Jan-2017 data date, and split land-constrained from available fronts as the Engineer asks. That keeps the land delay visible while showing progress where work was possible.

Step 2

Ask in plain language

Ask the way you would ask a colleague. Infiny sends the question to the specialist agents it needs.

Yes, the notice was in time. Handover was due on 05-Dec-20161 and our notice followed on 02-Jan-20172, inside the 28 days of Sub-Clause 20.13. No delay damages can be levied until the EOT claim is determined4.
